Terms of Service

By creating an account, accessing, or using ExportComments (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

You must be at least 16 years old (or the age of digital consent in your country) to use the Service. By using the Service you represent that you meet this requirement and that you have authority to bind any organization you represent.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access.

Account sharing is not permitted on individual plans. Multi-seat usage is available on the Agency plan.

You agree not to:

• Export comments from private accounts or non-public content.
• Use the Service to harass, dox, or facilitate illegal activity against any person.
• Resell or repackage the Service as your own product without a written partnership.
• Reverse-engineer, scrape, or attempt to bypass rate limits or security controls.
• Upload or process data you do not have a lawful right to process.

Violation may result in suspension or termination without refund.

Paid plans are billed in advance through PayPal. Monthly subscriptions renew automatically until cancelled. The Starter pass is a one-time $3 charge that grants 3 days of access and does not auto-renew.

You can cancel anytime from the Billing page. Cancellation takes effect at the end of the current billing period.

We offer a 7-day money-back guarantee on monthly subscriptions provided you have not run a paid export. The Starter pass is non-refundable.

Open a ticket from the support page and we will process eligible refunds within one business day.

The Free tier is provided as-is with limited credits and features. We may modify or discontinue the Free tier at any time. Free-tier accounts that are inactive for 12 months may be deleted after notice.

You retain ownership of any data you import into or generate through the Service (including export files). You grant us a limited license to host, store, and display that data solely to provide the Service to you.

You are solely responsible for ensuring your use of the Service complies with applicable platform terms (TikTok, Instagram, YouTube, X) and law (including GDPR / CCPA).

All software, branding, designs, and documentation in the Service are the property of ExportComments or its licensors. You may not copy, modify, or create derivative works without permission.

The Service interacts with third-party platforms (TikTok, Instagram, YouTube, X). We are not affiliated with or endorsed by those platforms, and they may change APIs or terms at any time, which may affect or discontinue features without notice.

We aim for high availability but do not guarantee uninterrupted service. Maintenance, third-party outages, or platform changes may cause downtime. We are not liable for losses resulting from temporary unavailability.

You may delete your account at any time from Settings. We may suspend or terminate your account if you breach these Terms, fail to pay, or pose a risk to the Service or other users.

Upon termination your right to use the Service ends. Provisions that by their nature should survive (IP, liability limits, governing law) will survive termination.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT EXPORT DATA WILL BE COMPLETE OR ACCURATE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXPORTCOMMENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD $100, WHICHEVER IS GREATER.

You agree to indemnify and hold ExportComments harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

These Terms are governed by the laws of the European Union and, where applicable, the laws of the country in which ExportComments is registered, without regard to conflict-of-laws rules. Disputes will be resolved in the competent courts of that jurisdiction.

We may modify these Terms from time to time. Material changes will be announced via email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
